Spanish Football Federation Sees Agreement Between LaLiga And CVC Totally Illegal

New chapter before the agreement reached between LaLiga and the Luxembourg fund CVC Capital Partners . The Royal Spanish Football Federation (RFEF), one of the last institutions that had yet to speak, considers that the LaLiga Impulso project is “totally illegal.”

“This operation, carried out with the absence of the slightest publicity and concurrence in the selection of the winner, has two parts: the one related to the commercialization of audiovisual rights, on the one hand; and the rest of the LNFP businesses, which make up a heterogeneous group, on the other, “says the institution chaired by Luis Rubiales.

The RFEF has spoken out against the agreements reached between LaLiga and the fund in relation to the audiovisual rights of sports clubs and corporations (SAD). Thus, it has sent a burofax to LaLiga expressing its “firm opposition to this agreement.”

And it is that the RFEF explains that “not only for legal reasons, which will undoubtedly generate numerous litigation derived from the agreement and may call into question its own viability, since it is intended to force some legal institutions to the extreme; but also for economic reasons, since the rights of the clubs and SAD are heavily taxed for the next fifty years in exchange for a small amount of money “.

However, this is not the most important point for the Federation, but, in its opinion, “the agreement increases inequality and makes a fundamental and definitive way impossible for a reasonable evolution of the format of professional football competition in Spain, making that in practice and in application of the agreement the competition is petrified without the possibility of evolution or can only be modified when a third party outside the sports structure so decides or agrees on a fact that flagrantly violates the law and the European sports model “.

Likewise, the RFEF recalled that the agreement reached between the employers’ association and the Luxembourg fund “forgets the clubs that play non-professional competitions that, at the time of their promotion to professional competition, will see that their income is reduced by remuneration CVC, without having obtained any benefit from the contribution of that entity “.

From the Federation they affirm that they see “little rigorous and very opportunistic trying to cross the borders of the law to reach an economic and lousy and regrettable agreement for the future of all Spanish football and, on the other hand, fantastic for a fund and others possible beneficiaries “.

In addition, the RFEF has warned that it will not consent “to reduce during those fifty years the contribution to modest football that comes from these audiovisual rights.”

In the opinion of the Federation, “Royal Decree-Law 5/2015 established a very beneficial centralized marketing model for the LNFP, establishing controls and mandatory contributions for certain purposes. If the LNFP now intends to bypass controls and reduce contributions to which the Royal Decree-Law obliges it, the RFEF will be obliged to exercise the appropriate legal actions to defend its rights and those of non-professional football. At this point it should be remembered that the Higher Sports Council would find itself in the same situation than the RFEF “.
